This Privacy Policy is provided by BMO Financial Corp. (“BMO Harris”) for consumer customers who obtain or have obtained a financial product or service at any branch, location, office, call center, service center, online banking or telephone banking or similar facility that is identified by the M&I name, brand or logo (“M&I Location”) primarily for personal, family or household purposes (“M&I Consumer Customers”). “M&I” includes the former Marshall & Ilsley Corporation and its affiliated companies including, but not limited to, M&I Marshall & Ilsley Bank and M&I Bank FSB that were merged with BMO Harris Bank N.A. This Privacy Policy replaces any privacy policy or privacy statement previously issued by M&I.
We appreciate the opportunity to help you meet your financial needs. Earning and keeping your trust has been at the core of our business for over a century. We are committed to protecting the personal and financial information you have entrusted to us. It is important for you to understand what information we will collect, how we will use it, and who may see it. We are required by federal privacy regulations to notify you annually of our privacy policy.
This Privacy Policy outlines our commitment to you and incorporates the following principles:
ACCOUNTABILITY
Employees are responsible for maintaining and protecting the personal information to which they have access. We have strict policies and procedures for protecting personal information and have designated individuals within our organization who are responsible for monitoring our compliance.
We are committed to protecting the privacy of our current customers. If you choose to close your account(s) or become an inactive customer, you will continue to be protected by the privacy policies and principles described in this policy.
When we are serving as the trustee of a trust or as the executor of an estate, we serve in a fiduciary capacity. We treat this role with the highest level of respect and care. When we serve in a fiduciary capacity, we are extremely restrictive with the sharing of fiduciary information within and outside the BMO Harris family of companies.
IDENTIFYING PURPOSE
When you become a customer or apply for additional products and services, we ask you for your personal information. Examples of the purposes for which we may collect and use this information include:
- to respond more accurately and efficiently to your requests
- to verify your identity, secure your accounts and protect against fraud
- to understand your financial service requirements
- to determine suitability of products and services for you
- to determine your eligibility for certain of our products and services or those of others, and offer them to you
- to set up and manage products and services you have requested, and
- to comply with federal and state legal or regulatory requirements
Your personal information may be verified with other parties such as credit bureaus, your employer and personal references.
COLLECTION OF INFORMATION
The information we may collect and maintain about you comes primarily from you during the course of your doing business with us. This personal information, not available publicly, comes from the following sources:
- Information you provide to us when you fill out an application, complete a form, or make a request for services. This includes your name, address, date of birth, Social Security Number, assets and income.
- Information from your transactions with us, such as your account balance, account usage, account positions and loan history.
- Information from credit reporting agencies or other parties such as credit history, employment history and demographic information.
- Information submitted by you on insurance applications or claims, such as medical information, that is used only for the specific purposes you have authorized.
- Information from our Web site(s), such as pages visited, downloads and other Web sites from which you linked to our site. This information is collected so the information we provide to you can be tailored to your particular needs and interests, as well as to enhance the performance of our site.
- Information from online planning tools that we offer, such as interactive calculators, to help you evaluate your personal finances or decide whether a product or service is right for you. This information, or that gathered from online payments and transfers, may be used in connection with the particular transaction you initiate.
Important Information about Procedures for Opening a New Account
To help the government fight the funding of terrorism and money laundering activities, federal law requires all financial institutions to obtain, verify, and record information that identifies each person who opens an account. What this means for you is that when you open an account, we will ask for your name, address, date of birth, and other information that will allow us to identify you. We may also ask to see your driver’s license or other identifying documents.
LIMITING USE AND DISCLOSURE OF INFORMATION
To protect your privacy, we limit the information we share both within and outside the BMO Harris family of companies. Unless you authorize us to, we will not share information about you except as outlined below.
Sharing and Use of Information Within the BMO Harris Family of Companies
The sharing and use of information within the BMO Harris family of companies (i.e., among our banks, our brokerage company, insurance company, investment advisory affiliates and other affiliated financial service companies) helps us to provide you with complete and superior customer service. We may share within the BMO Harris family of companies the information described above under the heading Collection of Information. This includes information about your transactions or experiences with us, information you supply on your account applications and information we receive from third parties. For example, we may share this information about you within the BMO Harris family of companies to provide you with services you have requested, to identify products and services for which you may be eligible and to offer products and services to you.
As an individual, you have the right to instruct us not to share among our banks, our brokerage company, insurance company, investment advisory affiliates and other affiliated financial service companies certain information (other than information about our transactions and experiences with you) from your account applications or information we receive from third parties.1 If you do not want us to share this information about you, please contact us (see Contact Us section) so that we may process this request for you.
If you have previously contacted us regarding your request, you do not need to contact us again. Your request not to share this information will apply to all of your accounts with us including any new account you open after your original request. If two or more customers jointly own an account or obtain a service the request not to share information will apply only to individual accounts in the requesting person’s name and any other accounts held jointly by that person, but not to any other accounts held individually or jointly by the other joint account owner.
Limiting Marketing from the Harris Family of Companies
Federal law gives you the right to limit some but not all marketing from the BMO Harris family of companies. Federal law also requires us to give you this notice to tell you about your choice to limit marketing from the Harris family of companies.
You may limit our affiliates within the BMO Harris family of companies, such as our banks, brokerage, insurance or investment advisory affiliates, or other affiliated financial service companies from marketing their products or services to you based on personal information about you that they may receive from other companies within the BMO Harris family of companies. This information includes your income, your account history and your credit score. Your choice to limit marketing will apply until you tell us to change your choice.

Please note that this does not prohibit the companies within the BMO Harris family of companies with whom you have an established business relationship from marketing their products and services to you unless you have requested that your name, address, email address and phone number be excluded from marketing lists (see Direct Marketing section). Your request not to share this information will apply to all of your accounts with us including any new account you open after your original request. For accounts held jointly by more than one customer, any account holder may opt out on behalf of the other account holders. Any opt-out instructions received from one owner of a joint account will only apply to individual accounts in that person’s name and any other accounts held jointly by that person, but not individual accounts held by the other joint account owner or other accounts held jointly by that person with other joint account owners.
Direct Marketing
Direct marketing is our communication to you by mail, telephone or electronic means to inform you about products and services that we think may be of interest and value to you. If you do not want to receive direct marketing from the Harris family of companies, you may request that we remove your name, address, email address and phone number from our marketing lists. Please contact us (see Contact Us section) so that we may process this request for you.2
Sharing Information with Companies Who Help Us Provide You Services
We may share the information described under the heading Collection of Information with companies external to the BMO Harris family of companies to complete a transaction you have requested or to help us service your account. For example, we may share information about you with non-financial companies that perform services for us, such as printing checks that you order, data processing, printing account statements or with companies that perform marketing services on our behalf. We are highly selective in choosing these companies. All companies with whom we do business are contractually obligated to comply with strict standards regarding security and confidentiality, and the information may be used solely for the purpose of providing the service we have requested the company to perform.
Sharing Information with Other Financial Service Providers
We may also share information about you with other financial service providers, including other banks, insurance companies or mortgage companies, with whom we have a joint marketing agreement to offer you additional products or services.3
Sharing Information in Other Situations
We may share the information described under the heading Collection of Information when we are permitted or required by law to do so. Examples include responding to a subpoena, conducting a fraud investigation or reporting to a credit bureau. We may also share this information when authorized by you to do so.
ACCURACY OF INFORMATION
We are committed to maintaining the accuracy of your personal information and ensuring that it is complete and up-to-date. If you ever discover inaccuracies in our data, or if your personal information changes, please notify us immediately (see section Contact Us) so that we can make the necessary changes.
USE OF APPROPRIATE SAFEGUARDS
We maintain physical, electronic and procedural safeguards to protect the information we have about you. Access to such information is limited to those of our employees who need to know such information in order to provide you with services to help you meet your financial needs. Our employees are subject to a corporate code of conduct and other policies that require maintaining the confidentiality of such information.
OPENNESS
This BMO Harris Privacy Policy is made available to you online at www.mibank.com, as well as in M&I Locations. It is provided annually to every customer. RESPECTING YOUR PRIVACY PREFERENCES
We fully respect your privacy preferences. Simply contact the M&I Location where you do business (or see Contact Us section) to discuss the options that are available to you to limit sharing of information among the BMO Harris family of companies and to limit marketing offers, including direct marketing, from the BMO Harris family of companies.
It may take several weeks to fully implement your request. Also, if you previously contacted us to request to opt out of direct marketing or to limit marketing offers or information sharing, you do not need to contact us again unless you want to change a choice you previously made.

PROTECTING YOUR IDENTITY
There are several things you can do to protect yourself and your family from identity theft and related crimes.
